I think it's a matter of sematics or legal definitions:
Encoding is for maintaining data usability and can be reversed by employing the same algorithm that encoded the content, i.e. no key is used.
Encryption is for maintaining data confidentiality and requires the use of a key (kept secret) in order to return to plaintext.

Encoding is done all the time in any digimode (just using ASCII format is a way of encoding) which encryption is restricted to satellite telecommand in the hamradio community.
This definition (if you unwind it even more) is totally compliant with the general idea of hamradio: being open and transparent to anybody.
